Judicial Review 2024

The High Court Judicial review agreed with Love Te Arai that the community should have been notified

Because we care about our native environment and pollution, we have been working with the Council to ensure the old Lake Road Quarry site is compliant and we had been assured that further actions which impacted the local environment would be publicly notified. However in 2023 we noticed that there was something new going on, and when we talked to the council they had granted a consent in January 2022 for the old Lake Road Quarry site to be used as a contractor's yard and storage depot with 300 truck movements per week, without notification to the public.

When we asked the council why this had happened, they couldn't answer, and so Love Te Arai asked for a judicial review against Auckland Council's non-notification of the consent. In February 2024 we received the judgement the from High Court whose decision is that Auckland Council erred in deciding the non-notification of the consent and this means that the consent is no longer valid.

We are a group called
LOVE TE ARAI

Founded in our community, we have banded together to preserve and enhance the natural ecology of the Te Arai region.
As a group, we help trap pests, do regenerative planting, treat kauri for dieback, monitor rare birds (Fairy Tern, Australasian Bitterns), and remove plastic from our beaches.
We are involved in caring for Te Arai so people who venture to our beautiful regional park, beaches, walking tracks, golf courses, horse riding trails, and events can enjoy the pristine environment.
